A Special Master appointed by the Fifth Judicial District Court, State of New Mexico, in Case No. D-505-CV-2019-00345, captioned AerSale, Inc. v. Mizar (20622), LLC, et al., will conduct a public sale of the following Airframes:
- Boeing model 727-225 aircraft bearing manufacturer’s serial number 20622 and formerly bearing United States Registration Number N353PA, registered to Mizar (202622), LLC
- Boeing model 727-225 aircraft bearing manufacturer’s serial number 20624 and United States Registration Number N355PA, registered to Mizar (202624), LLC
- Boeing model 727-225 aircraft bearing manufacturer’s serial number 20626 and formerly bearing United States Registration Number N356PA, registered to Mizar (202626), LLC
The sale will occur at 10:00 a.m. (MDT) on October 5, 2020 on the steps leading to the front entrance of the Chavez County District Courthouse, located at 400 N. Virginia Avenue, Roswell, New Mexico 88201.
The public sale of the Airframes is being conducted pursuant to a court order to pay a judgment of $52,751.19 against each registered owner (for a total of $158,253.57). The Airframes will be sold “AS IS” and “WHERE IS” to the highest bidder for cash, free and clear of all liens or interests of the parties to the lawsuit. Every bid made shall be deemed an irrevocable offer until the sale has been completed, and the sale is completed when confirmed by the Court. In the event the purchaser fails to pay the purchase price at sale, or make satisfactory arrangements with the Special Master for such payment, the Special Master may accept the next highest bid or proceed with the sale to the highest bidder. The purchaser(s) must remove the Airframe(s) from their current location within thirty (30) days of confirmation of the sale. The judgment holder will not credit bid unless no bids have been made. The proceeds of the sale of each Airframe shall be applied first to costs and expenses of such sale, including Special Master fees plus tax), then to payment of the $52,751.19 (plus costs, expenses, and any attorneys’ fees if awarded by the Court) owed by each registered owner. If any proceeds from the sale remain, such proceeds shall be deposited into the Court’s registry. The Special Master or his representative may postpone or continue the sale by public declaration at the time and place originally scheduled for such sale. No other notice of the postponed or continued sale need be given.
